1. RECITALS AND BACKGROUND
This Terms of Service Agreement (“Agreement”) is entered into between BOOKOURBUS, a registered Partnership Firm under the laws of India, and the User. BOOKOURBUS owns and operates an online booking platform accessible at www.bookourbus.com and its mobile applications, providing technology-based facilitation for bus ticket booking and tour package reservations. The User intends to utilize the Platform for availing services offered by third-party bus operators and tour providers. In consideration of the mutual promises and obligations herein contained, the parties agree to these Terms.
2. 1. DEFINITIONS AND INTERPRETATION
1.1 "Bus Operator" means any independent transport service provider listed on the Platform that offers inter-city, intra-city, or tour bus services. 1.2 "Tour Operator" means any entity offering packaged travel services, including transport, accommodation, and sightseeing arrangements. 1.3 "Platform" means the website, mobile application, API interface, and associated digital properties of BOOKOURBUS. 1.4 "Services" means booking facilitation, payment processing, customer support, and related functions provided by BOOKOURBUS. 1.5 "Ticket / Booking" refers to a confirmed seat or reservation issued electronically upon successful payment. 1.6 "User" means any natural person or legal entity that accesses or uses the Platform. 1.7 Interpretation: Headings are for convenience only. Words importing the singular include the plural and vice versa; references to statutes shall include amendments thereof.
3. 2. SCOPE OF AGREEMENT
2.1 This Agreement governs the use of the Platform and all Services offered through it. Acceptance constitutes a binding legal contract. 2.2 BOOKOURBUS acts solely as an intermediary and does not itself own or operate any bus, tour, or vehicle. 2.3 All transport and tour services are rendered by independent Operators who bear full responsibility for licensing, safety, and service quality. 2.4 Nothing in this Agreement shall create a partnership, agency, or employment relationship between BOOKOURBUS and the Operator or User.
4. 3. USER ACCOUNT AND ELIGIBILITY
3.1 Only individuals aged 18 years and above who are competent to contract under the Indian Contract Act, 1872 may register on the Platform. 3.2 The User agrees to provide accurate, current, and complete information and update it as required. 3.3 The User shall maintain confidentiality of login credentials and is responsible for all activities undertaken through the account. 3.4 BOOKOURBUS reserves the right to suspend or terminate accounts suspected of fraud or misuse.
5. 4. SERVICES PROVIDED BY BOOKOURBUS
4.1 BOOKOURBUS offers the following services: (a) Display of bus and tour options from independent Operators; (b) Search, comparison, and real-time availability features; (c) Secure payment gateway integration; (d) Issuance of electronic tickets and invoices; (e) Customer support and grievance redressal. 4.2 BOOKOURBUS does not guarantee seat availability, bus condition, or tour execution and bears no liability for service deficiencies by Operators.
6. 5. RELATIONSHIP BETWEEN BOOKOURBUS AND OPERATORS
5.1 Operators listed on the Platform are independent service providers with necessary licenses, permits, and insurance. 5.2 BOOKOURBUS does not control service delivery and is not responsible for Operator acts, omissions, or negligence. 5.3 Operators shall indemnify BOOKOURBUS against claims arising from their operations, including accidents or regulatory breaches.
7. 6. BOOKING AND CONFIRMATION
6.1 All bookings are subject to real-time availability from Operators. 6.2 Bookings are confirmed only upon full payment and electronic ticket issuance. 6.3 BOOKOURBUS may levy a non-refundable service fee. 6.4 Users must verify journey details and report discrepancies to support.
8. 7. PAYMENT TERMS
7.1 Payments shall be made using BOOKOURBUS-approved methods (cards, UPI, internet banking, wallets). 7.2 Prices include base fare, applicable taxes (GST), and convenience fees. 7.3 Additional charges (tolls, parking, permits) are payable directly to Operators. 7.4 BOOKOURBUS is not responsible for network or gateway failures. 7.5 Users must notify support immediately for failed transactions; refunds processed within 7–10 working days. 7.6 BOOKOURBUS reserves the right to amend prices or service charges.
9. 8. CANCELLATION, RESCHEDULING, AND REFUND POLICY
8.1 User-Initiated Cancellations (a) Governed by Operator’s cancellation policy; (b) Refunds after deduction of fees and service charges; (c) No refund for no-shows or late arrivals; (d) Refunds credited within 7–10 business days. 8.2 Operator-Initiated Cancellations (a) BOOKOURBUS facilitates refund or re-booking per Operator instructions; (b) Not liable for consequential losses; (c) Users not entitled to compensation beyond BOOKOURBUS’s control. 8.3 Rescheduling (a) Only if Operators allow; (b) Fare differences borne by User; (c) Rescheduled tickets cannot be canceled; (d) Tickets remain non-transferable.
10. 9. OBLIGATIONS OF USERS
9.1 Users must provide accurate personal details, valid ID, arrive 30 mins early, verify travel details, and follow safety instructions. 9.2 Users shall not engage in unlawful activity, disrupt the Platform, sell tickets, or post defamatory content. 9.3 Misuse may lead to account termination and legal action.
11. 10. OBLIGATIONS OF BUS AND TOUR OPERATORS
10.1 Operators must comply with Motor Vehicles Act, State Transport Rules, and Tourism Guidelines. 10.2 Maintain valid permits, certificates, insurance, and driver licenses. 10.3 Provide accurate fare, amenities, and schedule info; no misrepresentation. 10.4 Responsible for passenger safety, vehicle maintenance, timely travel, luggage handling, and complaints. 10.5 Breaches may lead to delisting or suspension by BOOKOURBUS.
12. 11. LIABILITY AND LIMITATION OF RESPONSIBILITY
11.1 BOOKOURBUS is only a technology intermediary and has no control over service performance. 11.2 Not liable for delays, cancellations, accidents, vehicle conditions, staff behavior, or property loss. 11.3 Users acknowledge all travel risks lie with Operators. 11.4 Maximum liability is limited to total booking amount. 11.5 No liability for indirect, incidental, or consequential damages.
13. 12. REPRESENTATIONS AND WARRANTIES
12.1 Users represent they have legal capacity, will comply with laws, and will not use bots or automation. 12.2 BOOKOURBUS represents it is registered, lawful, and employs reasonable data protection. 12.3 No guarantee of uninterrupted Platform, accurate Operator info, or satisfaction of travel expectations.
14. 13. DATA PROTECTION AND PRIVACY
13.1 User data protected under IT Act, 2000 and related rules. 13.2 Personal data used only for legitimate business purposes. 13.3 Technical safeguards to prevent unauthorized access. 13.4 No sale/disclosure except to Operators, law enforcement, or vendors bound by confidentiality. 13.5 Users may review, correct, or delete data via support@bookourbus.com. 13.6 Use of Platform implies consent to data processing per Privacy Policy.
15. 14. INTELLECTUAL PROPERTY RIGHTS
14.1 All content, design, logos, software, and trademarks are property of BOOKOURBUS or licensors. 14.2 Users granted limited, non-exclusive license for personal use. 14.3 Copying, modifying, distributing, or exploiting Platform content without consent is prohibited. 14.4 Violations may lead to access suspension and legal action.
16. 15. INDEMNIFICATION
15.1 Users indemnify BOOKOURBUS against claims, damages, losses, or expenses from: (a) Violation of Terms, (b) Misuse of Platform, (c) Intellectual property infringement, (d) Negligent or unlawful conduct. 15.2 Indemnification survives termination or expiration of Agreement.
17. 16. FORCE MAJEURE
16.1 BOOKOURBUS not liable for delays or failures due to events beyond control (natural disasters, terrorism, strikes, government restrictions, system failures). 16.2 Operations will resume as soon as practicable; no liability for resulting damages.
18. 17. TERMINATION AND SUSPENSION
17.1 BOOKOURBUS may terminate/suspend access if: (a) User violates Terms; (b) Fraudulent or illegal activity detected; (c) Required by law. 17.2 Termination does not affect accrued rights. 17.3 User access ceases immediately; outstanding dues payable.
19. 18. DISPUTE RESOLUTION AND GOVERNING LAW
18.1 Governed by laws of India. 18.2 Parties shall attempt negotiation/conciliation first. 18.3 If unresolved in 30 days, refer to arbitration under Arbitration Act, 1996: (a) Conducted in Lucknow, UP; (b) Sole arbitrator mutually appointed; (c) Language: English or Hindi; (d) Award is final and binding. 18.4 Courts of Lucknow and High Court of Allahabad have exclusive jurisdiction.
20. 19. NOTICES AND COMMUNICATIONS

21. 20. MISCELLANEOUS PROVISIONS
20.1 Entire Agreement: Supersedes all prior representations. 20.2 Severability: Invalid clauses do not affect remaining provisions. 20.3 Waiver: Delay or failure to exercise rights is not a waiver. 20.4 Assignment: User may not assign rights/obligations without consent. 20.5 Amendment: BOOKOURBUS may modify Terms; updates effective upon publication. 20.6 Language: English version prevails over translations.
22. 21. DECLARATION AND ACCEPTANCE
By accessing or using the BOOKOURBUS Platform, the User confirms reading, understanding, and agreeing to the Terms. Continued use implies unconditional acceptance of all terms and obligations. Disclaimer: BOOKOURBUS acts solely as a booking intermediary; operational and service liabilities rest with respective Operators.
